BILL

Babasaheb Initiative on Legal Loopholes

What is BILL?

Babasaheb Initiative on Legal Loopholes (BILL) is an initiative of the Legal Loophole Project, focused on disclosing and closing legal loopholes in anti-discrimination legislation across jurisdictions. The name “BILL” reflects the existence of legal loopholes in legislation and the goal of closing them through an amendment “bill”, emphasising that legal loopholes in anti-discrimination legislation can be closed only through legislative action rather than relying on strategic litigation.

The “B” in BILL refers to “Babasaheb”, meaning “Respected Father”, the honorific by which Dr. B. R. Ambedkar is widely known and respectfully addressed. Dr. Ambedkar played the principal role in drafting the Constitution of India and was the principal leader in the struggle against caste-based discrimination. BILL’s focus on legislative drafting and anti-discrimination law draws on these two aspects of his legacy. BILL is dedicated to Dr. Ambedkar in honour of his vision of achieving equality through law.

BILL aims to identify legal loopholes in existing anti-discrimination legislation and comparatively analyse them in order to develop precise legal language with unambiguous phrasing, along with hypotheticals illustrating specific offences. Examining these loopholes can help identify specific provisions that are being exploited by perpetrators. A comparative analysis of these loopholes can then help develop standards that may serve as a framework for drafting comprehensive anti-discrimination legislation.
